Clearing An Arrest Record After a Not Guilty Verdict

When a conviction doesn’t reflect the true procedural rights of a defendant, experienced appellate attorneys can make all the difference.

At Blizzard & Zimmerman Attorneys, we secured a crucial Petition for Discretionary Review (PDR) for a client who was denied the opportunity to file one due to procedural mistakes.

Expungement

Case Overview

Protecting Our Client’s Right to Appeal

Our client was facing a 10-year sentence on a criminal conviction but was unsure how to challenge it after his right to file a PDR was mishandled by the court. Upon reviewing his records, we identified that his PDR filing had been wrongly processed as a request for an extension of time -  and rejected by the Texas Court of Criminal Appeals (CCA).

Recognizing the procedural error, we took swift action and filed an 11.07 writ of habeas corpus seeking an Out-of-Time PDR.

This legal strategy allows a court to correct a denial of filing rights when a mistake outside the client’s control prevented a timely appeal

Outcome: Granting a Second Chance for Review

Thanks to our diligent appellate advocacy, the 11.07 writ was granted, restoring our client’s right to file a timely Petition for Discretionary Review with the Texas Court of Criminal Appeals. This granted PDR opens the door for further examination of issues from his conviction at the highest criminal court in Texas.

Although post-conviction relief can be complex and uncertain, our team remains committed to exploring every available legal avenue, including follow-up habeas filings if necessary, to seek justice for our clients.

Why This Matters in a Texas Criminal Case

Petition for Discretionary Review (PDR): A rare but vital appellate opportunity that allows the Texas Court of Criminal Appeals to review decisions of intermediate appellate courts. It is granted in a small percentage of cases when important legal issues are at stake.

11.07 Writ of Habeas Corpus: A powerful tool to restore appellate rights when mistakes outside a client’s control interfere with their ability to seek review.
