Post Conviction Results
Successful 11.07 Writ – Out of Time Appeal – New Trial – Organized Criminal Activity
Summary
Our client was initially convicted of engaging in organized criminal activity and sentenced to 54 years in prison. Unfortunately, the client’s trial attorney failed to file a notice of appeal, which led us to take post-conviction action on their behalf.

Legal Action Taken
We filed an 11.07 application for a writ of habeas corpus, seeking an out-of-time appeal due to the oversight of the client’s trial attorney. This legal maneuver was crucial in reopening the path to justice for our client.
Court’s Decision
The trial court reviewed our application and recommended granting the late appeal. The Texas Court of Criminal Appeals concurred with this recommendation and formally granted the 11.07 application.
Outcome
With the cause remanded to the trial court, we swiftly filed a Motion for New Trial. Our efforts were successful, and the trial court granted this motion in January 2021, giving our client a much-needed second chance at justice.
