Post Conviction Results

Journey from Conviction Challenge to Potential Relief

Case Background

A client approached us with the intention of challenging his conviction and 10-year sentence. However, he was unsure of how to proceed. After several discussions and a preliminary review of his records, we discovered procedural errors that denied him the right to file a petition for discretionary review (PDR) at the Texas Court of Criminal Appeals (CCA).

The PDR he attempted to file was mistakenly treated as a request for an extension of time and subsequently denied by the CCA.

Recognizing these procedural issues, we took immediate action by filing an 11.07 writ of habeas corpus for Out of Time PDR to the CCA, detailing the complexities of his case.

Outcome

The writ was successfully granted, allowing us to prepare and file a timely PDR for our client.

Should this PDR be denied at the CCA, our next course of action is to prepare and file an 11.07 Application for Writ of Habeas Corpus on his behalf.

Our Commitment

We maintain transparency and are honest with our clients, acknowledging that post-conviction relief is challenging and offers no guarantees. It’s an elusive remedy with no guarantee.

Despite the uncertainty, we assure our clients that we will work diligently and skillfully to provide the best opportunity for relief.

We are committed to seeing this case through and will continue to provide updates as our client navigates the post-conviction process.
